Terms of Service

These Terms of Service govern your use of the Trakify app, operated by Trakify App Ltd ("we", "us", "our"), a company registered in England and Wales.

By downloading or using Trakify, you agree to these terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old to use Trakify. By using the app, you confirm that you meet this requirement. If you are under 18, you confirm that your parent or guardian has reviewed and agreed to these terms with you.

2. Your Account

To use Trakify, you must create an account using Sign in with Apple. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You must provide accurate information when creating your account. You may not share your account with others or use another person's account without their permission.

We reserve the right to suspend or terminate your account if we believe you have violated these terms.

3. Subscriptions and Payments

Subscription plans

Trakify is available on monthly and annual subscription plans. Current subscription prices are shown in the App Store and within the app before you subscribe. The annual subscription includes a 7-day free trial for new subscribers.

Free trial

If you sign up for the annual subscription, you will receive a 7-day free trial. If you do not cancel before the trial ends, your subscription will automatically begin and the annual price will be charged to your Apple ID account.

Billing and renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged within 24 hours before the end of the current period. All payments are processed by Apple through the App Store — we do not handle your payment details directly.

Cancellation

You can cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period and you will continue to have access to Trakify until then.

Price changes

We may change subscription prices from time to time where permitted by the App Store. If we do, Apple will manage notice and billing of the new price through the App Store subscription system. If you do not agree to the new price, you can cancel your subscription before the change takes effect.

Refunds

Refund requests are handled by Apple in accordance with their App Store refund policy. We do not process refunds directly. To request a refund, contact Apple support or visit reportaproblem.apple.com.

4. Acceptable Use

You agree to use Trakify only for lawful purposes and in accordance with these terms. You must not:

• Use the app in any way that violates any applicable law or regulation

• Attempt to reverse engineer, decompile, or disassemble any part of the app

• Scrape, copy, or extract data from the app by automated means

• Attempt to gain unauthorised access to any part of the app or its infrastructure

• Use the app to transmit any harmful, offensive, or unlawful content

• Interfere with or disrupt the integrity or performance of the app

• Impersonate any person or misrepresent your affiliation with any person or organisation

We reserve the right to suspend or terminate your account if you violate any of these restrictions.

5. Your Content

Trakify allows you to enter free-text notes alongside your workout and exercise data. You own the content you create. By entering content into the app, you confirm that it does not violate any applicable law or the rights of any third party.

We are not responsible for any content you enter into the app. You are solely responsible for ensuring that any notes or content you add are lawful and appropriate.

6. Health and Safety

Trakify is a general fitness and nutrition tracking tool and does not provide medical advice, diagnosis, or treatment. You are responsible for deciding whether any exercise, diet, or fitness activity is appropriate for you.

Before beginning any new diet, exercise programme, or fitness activity, you should consult a qualified healthcare professional, particularly if you have any pre-existing medical conditions, are taking prescription medication, or are following a therapeutic diet.

Calorie calculations, macro targets, and other nutritional figures provided by Trakify are estimates based on the information you provide. They are not a substitute for professional nutritional advice.

Trakify is not a regulated medical device and is not intended for the diagnosis, prevention, monitoring, or treatment of any disease or physiological condition.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence.

7. Intellectual Property

Trakify and all of its content, features, and functionality — including the app design, graphics, logos, and code — are owned by Trakify App Ltd and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the app for your personal, non-commercial purposes in accordance with these terms. You may not copy, modify, distribute, sell, or lease any part of the app or its content.

Any claim that Trakify infringes a third party's intellectual property rights is the responsibility of Trakify App Ltd, not Apple.

8. Digital Content and Consumer Rights

Trakify is a digital service supplied under the Consumer Rights Act 2015 and will be provided with reasonable skill and care. Where applicable, digital content supplied through Trakify must be of satisfactory quality, fit for purpose, and as described. If Trakify is faulty or does not conform to applicable consumer law, you may have statutory rights and remedies.

If you subscribe and request immediate access to Trakify during the 14-day cancellation period, you acknowledge that the service will begin immediately and that, to the extent permitted by law, you may lose your right to cancel once supply has begun. This does not affect any statutory rights or remedies you may have if Trakify is not supplied as required by law.

9. Availability and Changes to the App

We aim to keep Trakify available at all times but we do not guarantee uninterrupted access. The app may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may modify or update the app from time to time, including to fix bugs, improve performance, or add features. We will use reasonable efforts to give notice of any material adverse changes to core functionality. If you continue to use Trakify after those changes take effect, you accept the updated version of the app.

10. Privacy

Your use of Trakify is also governed by our Privacy Policy, which is available at trakify.app/privacy and explains how we collect, use, and store your personal data.

11. Apple App Store

Trakify is made available to you through the Apple App Store. These terms are between you and Trakify App Ltd only — not Apple. Apple is not responsible for Trakify or its content and has no obligation to provide maintenance or support for the app.

In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of Trakify. Any other claims, losses, liabilities, damages, costs, or expenses arising from the app are the sole responsibility of Trakify App Ltd.

Apple is not responsible for addressing any claims you have relating to Trakify, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, or claims arising under consumer protection law.

You and Trakify App Ltd acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance of these terms, Apple will have the right to enforce them against you as a third-party beneficiary.

You represent and warrant that you are not located in a region subject to a US government embargo or designated as a terrorist-supporting region, and that you are not listed on any US government list of prohibited or restricted parties.

You must comply with applicable third-party terms of service when using Trakify, including Apple's App Store terms.

12. Disclaimer of Warranties

Except as expressly set out in these terms and to the extent permitted by law, we do not make additional warranties about uninterrupted availability or that the app will be error-free. Your statutory rights under applicable consumer law are not affected by this section.

13. Limitation of Liability

To the fullest extent permitted by law, Trakify App Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, including but not limited to loss of revenue or loss of profits.

We recommend that you keep your own records of important information. Nothing in these terms excludes any rights you have under applicable consumer law if Trakify fails to meet the standards required by law.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

14. Termination

You may stop using Trakify at any time and delete your account from within the app.

We may suspend or terminate your access to Trakify at any time if we believe you have violated these terms, if your account has been used fraudulently, or if we are required to do so by law. Where possible we will give you notice before doing so.

On termination, your right to use the app ceases immediately. Sections of these terms that by their nature should survive termination will do so, including sections on intellectual property, health and safety, disclaimers, and limitation of liability.

15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of Trakify will be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer law in your country of residence gives you the right to bring proceedings in your local courts.

16. Changes to These Terms

We may update these Terms of Service from time to time. If we make material changes, we will give reasonable notice. If you do not agree to the updated terms, you should stop using Trakify and cancel any subscription before the changes take effect. The last updated date at the top of this page will always reflect the latest version.

17. General

These terms, together with our Privacy Policy, constitute the entire agreement between you and Trakify App Ltd regarding your use of the app and supersede any prior agreements between us.

If any provision of these terms is found to be invalid or unenforceable, that provision will be severed and the remaining terms will continue in full force and effect.

Our failure to enforce any right or provision of these terms will not constitute a waiver of that right or provision.

You may not assign or transfer your rights or obligations under these terms to any other party without our prior written consent.
